Terms for Specialists (Independent Psychologists)
1. General Provisions
These Terms govern the cooperation between the Tanvelora platform and independent psychologists (hereinafter referred to as "Specialist").
The operator of the platform is:
TANDOORIA Spółka z ograniczoną odpowiedzialnością NIP: 6772520369 KRS: 0001148378 Address: ul. Wielicka 42 lok. B3, 30-552 Kraków, Poland (hereinafter referred to as "Company").
The Company provides exclusively a technological platform for communication between users and specialists, and acts as a payment agent (Merchant of Record).
2. Status of the Specialist
2.1. The Specialist is an independent entity and is not in an employment relationship with the Company.
2.2. The Specialist is not a representative, agent, or employee of the Company.
2.3. The Specialist is solely responsible for:
the legality of their activities
compliance with the requirements of their jurisdiction
having the appropriate education and qualifications
tax payments on their received payouts
3. Nature of Services
3.1. The Specialist provides consulting or psychological services in their own name.
3.2. The Company does not engage in medical or therapeutic activities.
3.3. The Company does not control the content of consultations and is not responsible for individual recommendations.
4. Payment and Commission (Agency Model)
4.1. The Company acts as the Merchant of Record (MoR) and accepts payments from end-users on behalf of the Specialist.
4.2. Payment for services is made through the platform's payment gateways (e.g., Stripe).
4.3. The Company retains a commission for the use of the platform and acquiring fees. The remaining funds are held on the platform balance.
4.4. Payouts to the Specialist are processed periodically (e.g., monthly or upon request) to the Specialist's designated bank account or payment method.
4.5. The amount of the commission is specified separately in the personal account or contract.
5. Prohibition of Circumventing the Platform
5.1. The Specialist agrees not to transfer clients outside the platform to avoid commission fees.
5.2. Violations may result in account suspension.
6. Limitation of Liability and Chargebacks
6.1. The Company does not guarantee a minimum number of clients.
6.2. The Company is not responsible for disputes between the Specialist and the User.
6.3. If an end-user initiates a chargeback or requests a refund for a service that was not provided by the Specialist, the Company has the right to deduct the disputed amount and any associated bank fees from the Specialist's balance or future payouts.
6.4. The Company's liability is limited to the amount of the commission received for the respective transaction.
7. Suspension and Termination of Cooperation
The Company has the right to terminate the Specialist's access in case of:
a violation of these Terms
user complaints
illegal activities or fraudulent chargebacks
8. Law and Jurisdiction
The Terms are governed by the laws of the Republic of Poland. Disputes are resolved by the courts of Kraków.
